Orders

Because customer service is paramount to our business, we reserve the right to limit quantities of items purchased by each customer. We reserve the right to cancel any order or part of an order, or refuse service to anyone for any reason, including without limitation product availability and price discrepancy. We reserve the right to charge fees or extra shipping charges for any product that is backordered. The posting of prices on our site is not an offer for sale of goods, and the order confirmation is not an acceptance of an offer to purchase goods. The contract for sale of goods between us and any customer is not entered into until we charge a valid credit card or otherwise accept payment.

Disclaimer and Limitation of Liability

We have made every effort to accurately display and describe all products offered for sale and/or sold by Stuff for Sprouts on the Site (collectively, the “Products”). However, we do not warrant that the Product descriptions are accurate, complete or error-free. If a Product offered by the Site is not as described, your sole remedy is to return it in unused condition.

Customer reviews included in the “People are Talking . . .” section of our Site and elsewhere are included for your information and do not constitute warranties from us.

Stuff for Sprouts does not make any warranties with respect to the products. Stuff for Sprouts expressly disclaims all warranties, express or implied, with respect to the products, including without limitation warranties of merchantability and fitness for a particular purpose.

In the event any product is defective, your sole remedy will be to return the product to Stuff for Sprouts for a replacement [or refund of the original sale price]. In no event will Stuff for Sprouts be liable to you or others for any consequential, special, indirect, incidental, exemplary or punitive damages, even if Stuff for Sprouts has been made aware of the possibility of such damages. Stuff for Sprouts’ maximum liability with respect to the products will not exceed the original sales price paid for such products.

Consumer rights: Some states do not allow the exclusion or limitation of incidental or consequential damages or limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. These warranties give you specific legal rights and remedies; you may also have other rights and remedies which arise from operation of law and vary from state to state.
